Ordnungsamt Frankfurt stempelt rechtswidrigen und diskriminierenden Vermerk in Pass von Roma aus Rumänien
Der Sozialberatung des Förderverein Roma liegt der Pass einer Romni aus Rumänien vor, in den ein Mitarbeiter des Ordnungsamts Frankfurt den Vermerk „Beim aggressiven Betteln angetroffen“ mit Datum und Unterschrift gestempelt hat. Die Passinhaberin berichtet, ein Schild mit Bitte um eine Spende hätte zum Vermerk und zur Überprüfung der Papiere auf der Wache geführt. Die Situation ist von der Frau und ihrer Freundin, die ebenfalls ein Vermerk in den Pass erhielt, als bedrohlich und ängstigend erlebt worden. Auf eine Übersetzung wurde seitens des Ordnungsamtes nicht geachtet.
Beide Frauen kommen aus der rumänischen Stadt Gheorgheni. Roma leben dort in ärmlichen Hütten ohne jegliche Versorgung, sind vom Regelschulbesuch ausgeschlossen und konfrontiert mit neonazistischen Pogromen.
Der beschriebene Eintrag entbehrt nach Auffassung des Förderverein Roma jeder Rechtsgrundlage und führt zur Ungültigkeit des Passdokuments, das Eigentum des rumänischen Staates ist. Das Vorgehen zeigt in skandalöser Weise die Spitze von Ausgrenzung und Stigmatisierung. Die Passinhaberin wird ungeachtet der Entwertung bei jeder Überprüfung durch den Stempel denunziert, jeder Grenzübertritt wird zum Spießrutenlauf. Der ebenso unmenschliche wie unrechtmäßige Verwaltungsakt erinnert zudem an rassistische Vermerke in Passdokumenten von Roma und Sinti, deren Intention allein in der Herabwürdigung, Verfolgung und Demütigung der Betroffenen lag.
Nach der Räumung der Brache im Frankfurter Gutleutviertel und dem Camp an der ehemaligen Europäischen Zentralbank, nach dem Vertreiben von Roma-Frauen in der Gutleutstraße und den aktuellen Barverwarnungen stellt der Sichtvermerk im Pass eine weitere Eskalationsstufe dar, deren Ziel die Vertreibung von obdachlosen Roma-MigrantInnen aus der Stadt Frankfurt ist. Statt Alternativen bereit zu stellen und Armut zu bekämpfen, werden, wie in anderen deutschen Städten, Ausgrenzung und Kriminalisierung favorisiert. Letztlich endet die Praxis in der Absicht, den Aufenthalt durch den Entzug der Freizügigkeit zu beenden und die Abschiebung mit Rückreisesperre durchzusetzen – eine umfangreiche Entrechtung von EU-BürgerInnen.
Der Förderverein Roma leitet rechtliche Schritte gegen die Verfahrensweise des Ordnungsamtes Frankfurt ein. Darüber hinaus wird der Anspruch auf Schadenersatz geprüft und der Datenschutzbeauftragten des Landes Hessen sowie das rumänische Generalkonsulat über den Vorfall informiert.
