Am 13.04.2017 wurde das Studierendenhaus der Goethe-Universität Frankfurt am Main von der Polizei durchsucht. Auf Antrag des AStAs hat das Amtsgericht Frankfurt nun die Rechtswidrigkeit des Einsatzes festgestellt. „Wir hätten nicht erwartet, dass man den Rechtsprozess so in die Länge ziehen würde. Erst nach Androhung, Klage wegen Verfahrensverschleppung einzulegen, gewährte uns die Staatsanwaltschaft überhaupt Akteneinsicht. Enttäuscht hat uns hierbei vor allem die fehlende Unterstützung seitens des Uni-Präsidiums. Es wurde sogar versucht, uns daran zu hindern, unseren öffentlichen Unmut über das rechtswidrige Handeln der Polizei zu äußern.“ Die Überprüfung des Falles beim Amtsgericht nach fast zwölf Monaten offenbarte, was schon zuvor vermutet und kritisiert wurde. Die Polizei überschritt ihre Kompetenzen und versuchte, ohne richterlicher Anordnung pauschale Verdächtigungen als ausreichende Begründung für “Gefahr in Verzug” auszugeben. Sie hat damit jenseits der Rechtsstaatlichkeit versucht, übereifriges Handeln als legitimes Gewohnheitsrecht durchzusetzen. AStA-Co-Vorsitzender Johannes Fechner sieht hier vor allem die Polizei in der Pflicht: “die Frankfurter Polizei kann den Anschein von Glaubwürdigkeit jetzt nur noch dadurch bewahren, dass sie einen verantwortungsvollen Umgang durch personelle Konsequenzen zeigt und das rechtswidrige Handeln eingesteht.”
