Erfolg! Stadt Frankfurt muss geplante politische “Zuverlässigkeitsüberprüfungen” bei MitarbeiterInnen von Flüchtlingseinrichtungen zurücknehmen
Für große Aufregung, Protest und Verärgerung bei den Beschäftigten, den Betriebsräten und Geschäftsleitungen freigemeinnütziger und privater Unternehmen, die in der Arbeit mit Geflüchteten tätig sind, sorgte im März 2018 eine Mail der Stabsstelle Flüchtlingsmanagement der Stadt Frankfurt.
Die Unternehmen wurden in Kenntnis gesetzt, dass “alle Personen, die in Flüchtlingsunterkünften zu Dienstleistungen eingesetzt werden, einer polizeilichen Sicherheitsüberprüfung unterzogen werden” sollen. Dabei soll die Polizei überprüfen, ob Beschäftigte in den diversen Polizei-Datenbanken im Zusammenhang mit Sexualdelikten, Drogenhandel, extremistisch motivierter Tätigkeit (rechts / links / salafistisch), Ermittlungen wegen Rockerorganisation und/oder Körperverletzung erfasst und gespeichert wurden. Die Beschäftigten sollten aufgefordert werden, einen umfangreichen Fragebogen zu beantworten.
Selbst Empfehlungen der Stadt Frankfurt, dass die angeschriebenen Organisationen Beschäftigte ggf. noch während der Probezeit kündigen sollten, wurden abgegeben. Krönchen des ganzen: Bar jeglicher datenschutzrechtlicher Vorgaben wurden die angeschriebenen Organisationen aufgefordert, die ausgefüllten Fragebogen einzuscannen und unverschlüsselt per eMail an die Stadt Frankfurt zu senden.
Proteste aus den Reihen der Beschäftigten, ihrer Betriebsräte und den Geschäftsleitungen der in der Arbeit mit Geflüchteten tätigen freigemeinnützigen und privaten Unternehmen haben die Stadt Frankfurt bewogen, diese Schnüffel-Aktion jetzt – mindestens vorerst – abzublasen. Die Mitarbeitervertretung eines großen freigemeinnützigen Vereins teilte den Beschäftigten am 17.04.2018 mit: “…wir wurden von unserer Geschäftsführung informiert, dass die Stabsstelle Flüchtlingsmanagement gestern alle Träger angeschrieben und mitgeteilt hat, dass die rechtliche Situation neu bewertet wurde und die Zuverlässigkeitsüberprüfung nicht mehr durchgeführt werden muss.” Zugleich wurde mitgeteilt, dass das Frankfurter Netzwerk der Sozialen Arbeit weiterhin plant, die Sitzung des Sozialausschusses der Stadtverordnetenversammlung am 19.04.2018 zu nutzen, um dort öffentlich zo protestieren und die dauerhafte Rücknahme der Schnüffel-Aktion zu fordern. In dieser Sitzung wird unter TOP 63 ein Antrag der Fraktion Die Linke zu diesem Thema beraten.
Es darf begründet vermutet werden, dass die von der Stabsstelle Flüchtlingsmanagement geplante rechtswidrige Schnüffel-Aktion inspiriert wurde von den Plänen der hessischen Landesregierung (CDU/Grüne), mit dem neuen hessischen Verfassungsschutzgesetz eine Rechtsgrundlage für die Bespitzelung der MitarbeiterInnen von Beratungsstellen gegen Rechtsextremismus, Rassismus und Antisemitismus zu schaffen.
Die Bürgerrechtsgruppe dieDatenschützer Rhein Main hat den behördlichen Datenschutzbeauftragten der Stadt Frankfurt in einem Schreiben aufgefordert, die jetzt – zumindest vorerst – abgeblasene Schnüffel-Aktion auf ihre datenschutzrechtliche Relevanz zu prüfen.
